
Kevin Walsh is a partner in our New York office and a member of our Business Litigation team and our Reinsurance Core Group. He has many years of experience in handling complex commercial litigation and arbitration in state and federal courts as well as domestic and international arbitrations under the aegis of the American Arbitration Association, the International Chamber of Commerce and before the Iran-United States Claims Tribunal. His international litigation experience ranges from mass tort actions with international elements to current matters involving claims of war crimes in Iraq and claims under the Alien Tort Claims Act. He has extensive experience with both civil and criminal fraud issues, including advising clients with respect to bankruptcy proceedings resulting from the Madoff fraud.
Mr. Walsh has represented both plaintiffs and defendants in litigations involving securities fraud claims, advised reinsurers in connection with SEC and FSA inquiries into use of finite reinsurance, and represented both cedents and reinsurers in facultative and treaty disputes (arbitration and litigation). He has extensive experience in antitrust matters, including cases involving international cartels, and monopolization and price fixing class action conspiracy cases. Mr. Walsh has also represented companies and directors in corporate governance cases including injunctive proceedings involving mergers and acquisitions in Chancery Courts in Delaware and New Jersey.

Representative Experience
- Representing a private security company defendant in action involving claims under the Alien Tort Claims Act and in related state court proceedings;
- National counsel to title insurance company in antitrust price fixing class actions pending in federal district courts across the country and in appeals in several circuits arising from successful dismissal motions in these cases;
- Represented a major international financial institution defendant in a class action under the Alien Tort Claims Act, asserting that companies which had done business or facilitated transactions in South Africa during the apartheid period had violated international law by doing so;
- Represented savings and loan institution in New Jersey Chancery Court proceedings, defending against shareholders class attempt to enjoin proposed shareholder vote on acquisition (injunction denied);
- Represented financial institution trustee in injunction hearing in federal district court (New York) regarding trustee’s duties under Trust Indenture for collateralized debt obligation (injunction denied) (2008 WL 517017);
- Represented reinsurer in claims against off shore retrocessionaire and in related dispute with U.S. ceding company;
- Represented non US reinsurer and employees and former employees in responding to SEC investigation of finite reinsurance transactions;
- Represented reinsurers as plaintiffs against reinsurance intermediary which violated its fiduciary obligations and converted fiduciary funds (premium and loss payments). Receiver appointed and $7 million recovered for reinsurers and cedents;
- Represented shareholder/creditors of a Guernsey reinsurance company in liquidation proceeding in Guernsey and in related litigation in New York and Pennsylvania;
- Represented run-off reinsurer of financial insurance (residual value, automobile financings) in private arbitrations seeking rescission due to cedent’s failure to disclose adverse developments; and
- Represented business owner whose assets were expropriated by the Islamic Republic of Iran in claim which was tried before the Iran-United States Claims Tribunal, obtained judgment for plaintiff. 8 Int’l Arb.R. (Mealey Publications) No 2 at A-1.
