
Doug Sargent is an associate in Locke Lord’s Litigation Department and a member of the Firm’s Class Action and Real Estate & Finance practice groups. Mr. Sargent’s practice focuses primarily on the representation of banks and other financial institutions in both state and federal courts. Mr. Sargent has substantial experience in complex commercial, class action, and contested foreclosure litigation in jurisdictions across the country. Mr. Sargent regularly defends mortgage lenders, securitizers, servicers and other financial institutions in individual and class action lawsuits. These lawsuits often involve claims under the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), the Fair Credit Reporting Act (FCRA), the Fair Debt Collection Practices Act (FDCPA), as well as claims for fraud, breach of contract and breach of fiduciary duty. Mr. Sargent also has significant experience in handling asset-based and real estate loan workouts for a number of banks and financial institutions. He assists clients in negotiating forbearance agreements, loan restructuring and liquidations, including sales pursuant to the Uniform Commercial Code. When necessary, Mr. Sargent enforces his clients’ rights through foreclosure, replevin, injunction and other proceedings, especially when needed to avoid misappropriation of collateral and fraudulent transfers.
