Martin Jaszczuk is the head of Locke Lord’s TCPA Class Action Litigation Section. A TCPA defense lawyer who has tried over 100 cases since his early days as a criminal lawyer, Mr. Jaszczuk focuses his practice on the defense of class action lawsuits brought under the Telephone Consumer Protection Act. Mr. Jaszczuk represents some of the largest public and private companies in their bet-the-company TCPA class actions throughout the United States. He has written several articles and spoken at seminars on the topic, including most recently:
- Author, “How Far is Too Far? The FCC’s Attempt to Expand the Telephone Consumer Protection Act Beyond Congressional Intent,” Law 360 (October 26, 2012)
- Author, “FCC Sides with Telemarketing Industry: Opt-Out Confirmation Texts Do Not Violate the TCPA,” Law 360 (December 4, 2012)
- Speaker, “Webinar: Telephone Consumer Protection Act,” Locke Lord LLP (December 6, 2012)
- Speaker, “TCPA Class Actions: A Primer for Reinsurers,” REACH Seminar, DLA Piper LLP (US) (February 7, 2013)
Mr. Jaszczuk is routinely sought out to both defend companies that have been alleged to have violated the TCPA and to help corporations structure effective and compliant telemarketing programs to avoid TCPA lawsuits and regulatory actions in the first place.
In addition to his TCPA practice, Mr. Jaszczuk has also represented companies in (a) complex business and commercial disputes; (b) insurance and reinsurance coverage actions; (c) securities litigation and FINRA arbitrations; and (d) real estate-related matters.
Mr. Jaszczuk has represented some of the world’s largest insurers and reinsurers, both domestic and international, in their most serious multifaceted insurance coverage actions.
- In the securities and financial fields, Mr. Jaszczuk has defended numerous broker-dealers, investment advisers and related financial entities in FINRA arbitrations, SEC actions and FINRA enforcement actions.
- In the real estate field, Mr. Jaszczuk handled matters involving evaluation and due diligence analysis of complex real estate investments; REITs, TICs and 1031 exchange transactions; and operations-related issues such as land acquisition, development, architectural copyrights, construction defects, financing arrangements, lease agreements, management contracts, joint ventures, insurance claims and asset disposition.
As a result of his broad background, Mr. Jaszczuk has been invited by the Consul of the Commercial and Economic Department of the Consulate General of Poland in Chicago to speak at seminars for business groups from Poland and other European countries.
Owing to the breadth of his experience, Mr. Jaszczuk is consistently able to focus on the “big picture” to find innovative solutions to his clients’ complex problems.
He is able to serve his clients in English, Polish and German.
