
Ginger Appleberry is a trial attorney with experience representing clients in pharmaceutical False Claims Act and Qui Tam suits including governmental investigations regarding pharmaceutical pricing, marketing, and promotion in a number of jurisdictions. She has appeared on behalf of clients in Federal District Court, Bankruptcy Court, State Courts, and in arbitration. Ms. Appleberry also has significant experience with products liability, complex commercial litigation, theft of trade secrets, breach of fiduciary duty claims, adversary proceedings, fraud claims, personal injury, securities litigation, and landlord/tenant litigation.
In addition to her trial experience, Ms. Appleberry has experience counseling clients in data management and electronic discovery. She has managed electronic discovery collections, reviews, and productions in connection with complex civil litigation and governmental investigations.

Representative Experience
- Represent pharmaceutical and medical device manufacturers, including their former employees, in multiple state and federal lawsuits and investigations. These matters often involve allegations or suspicions of fraud, “off label” promotion, and/or unlawful pricing practices. Some involving purported claims and statutory penalties in excess of $1 billion.
- Defend pharmaceutical companies and medical device manufacturers in Medicaid Fraud claims brought by State Attorney Generals throughout the United States.
- Respond to Civil Investigative Demand discovery initiated by State Attorney Generals.
- Defend pharmaceutical and medical device manufacturers in False Claims Act and qui tam lawsuits.
- Advise aircraft and aircraft component manufacturer regarding the sale and marketing of products.
- Represent developers in construction litigation involving commercial, multi-family construction.
- Represent limited and general partners in disputes arising from partnership rights and obligations in a variety of contexts, including real estate partnerships.
- Represent insureds and insurance companies in coverage disputes.
- Enforce non-competition and non-solicitation provisions contained in employment contracts.
- Experience in adversary proceedings involving piercing the corporate veil, vice-principal liability, vicarious liability, and fraud related claims.
- Defend DTPA claims.
- Initiate and prosecute forcible entry and detainer actions.
