
Kevin Kelly is a partner in Locke Lord’s Labor & Employment group. He helps clients solve labor and employment law problems with practical, cost-effective solutions.
Mr. Kelly is an experienced litigator who has defended clients in a variety of actions, including:
- Discrimination and retaliation claims under Title VII, the Illinois Human Rights Act, and the Age Discrimination in Employment Act (ADEA)
- Discrimination and failure to accommodate claims under the Americans with Disabilities Act (ADA) and claims for alleged violation of the Family and Medical Leave Act (FMLA)
- Claims involving allegations of sexual and racial harassment in violation of state and federal law
- Class action wage and hour claims under the Fair Labor Standards Act (FLSA) and state law
- Class action claims under the Workers Adjustment and Retraining Notification (WARN) Act
- Claims for defamation, breach of contract, and intentional infliction of emotional distress
In addition to his experience in employment discrimination litigation, Mr. Kelly has also represented clients in non-competition and trade secret litigation in a variety of forums. He has prepared viable restrictive covenants for companies, and he has drafted numerous employment and severance agreements for C-level executives and other employees.
Mr. Kelly regularly assists clients with workplace investigations, wage and hour compliance reviews, reductions in force, employee handbook reviews, ADA reasonable accommodation issues, compliance with state and federal leave laws, implementation of pre-dispute arbitration programs, OSHA compliance, and affirmative action issues. He often conducts workplace training for supervisors on a variety of employment law topics.
Mr. Kelly is also experienced in traditional labor issues, such as union election campaigns, strikes and picketing, and negotiation of collective bargaining agreements. He has handled numerous labor arbitrations involving a variety of issues, and he regularly counsels companies in the construction, mining, and residential management industries on labor-management relations issues.
Mr. Kelly is also particularly experienced in several niche practice areas. He frequently counsels clients on Fair Credit Reporting Act (FCRA) compliance, both inside and outside of the employment context. He also counsels clients on e-mail and electronic communications management/retention issues. Additionally, he has significant experience in implementing alcohol and drug-free workplace policies and testing regimens nationwide.
Mr. Kelly’s previous experience includes four years of service in the U.S. Navy as Communications Officer and Ordnance Officer onboard the cruiser USS Ticonderoga (CG-47).

- Secured summary judgment for employer on a complex and groundbreaking ADA failure to accommodate claim in which he obtained a decision striking the purported “expert” testimony of the plaintiff’s vocational rehabilitation counselor under Daubert and Kumho Tire. - On four separate occasions, Mr. Kelly has obtained dismissals for employers after proving that a plaintiff has engaged in spoliation of evidence or lied under oath during a deposition
- Defended a staffing company in a class action case under the Illinois Wage Payment and Collection Act involving more than 21,000 class members and negotiated a comprehensive settlement of the matter on a claims-made basis
- Guided multiple clients through large-scale reductions in force in 2008 and 2009
