Kenneth McKay has experience in a wide range of litigation areas. He concentrates on commercial litigation and real estate litigation, including eminent domain/condemnation matters.
Mr. McKay is a head of the Litigation department of the firm’s Houston office. As one of Locke Lord’s senior trial partners, he has extensive trial experience in commercial and energy matters and eminent domain and condemnation cases. In the last decade, he has first-chaired over a dozen jury trial victories for clients, involving significant amounts in controversy.
Mr. McKay is also head of the firm’s Eminent Domain practice group, having practiced for more than 20 years in this area. His practice encompasses all aspects of eminent domain/condemnation law and right-of-way matters, including regulatory takings and inverse condemnation claims, as well as related commercial and real estate litigation. Mr. McKay regularly represents pipeline owners and operators, telecommunications providers, governmental entities and other common carriers, as well as select commercial and residential developers in condemnation cases and pre-condemnation counseling.
Mr. McKay is a frequent speaker and published author before various professional and legal organizations throughout the country on a variety of litigation and eminent domain topics and is an approved instructor for the Texas Real Estate Commission MCE courses, an active participant on committees of the Texas Association of Defense Counsel, Defense Research Institute, Construction Litigation Committee of the American Bar Association, State Bar of Texas and Houston Bar Association and a member of the International Right of Way Association.
