
Scott Jones has tried and defended cases in State and Federal court, as well as in arbitration. His trial and arbitration experience covers a range of issues with a particular focus on defending pharmaceutical manufacturers in Federal and State False Claims Act / qui tam lawsuits and whistleblower investigations, as well as defending aircraft and aircraft component manufacturers in products liability and commercial disputes. Mr. Jones also regularly advises and defends one of the Firm’s private equity clients in connection with disputes and other commercial matters involving that client’s various portfolio companies, including a recent jury trial defending one such portfolio company. Mr. Jones also has litigated and obtained summary judgment in cases ranging from disputed oil and gas interests to litigation involving personal injury claims against a major international airport.
While Mr. Jones’s practice and habit is to seek opportunities to quickly and efficiently free his clients from the expense, burden, and distraction associated with litigation and trial, his experience in the courtroom enables him to prepare a case for trial when dispositive motions and mediation do not prevail.
In addition to his trial work, Mr. Jones also routinely advises clients regarding the adoption of and adherence to document retention policies that comply with applicable and evolving legal standards.

Representative Experience
- Past and ongoing representation of various pharmaceutical and medical device manufacturers, including their former employees and officers, in state and federal lawsuits and investigations. These matters frequently involve allegations or suspicions of fraud, “off label” promotion, and/or unlawful pricing practices, many involving purported claims and statutory penalties in excess of $1 billion. Mr. Jones also has had occasion to present on the subject of “off label” promotion and regulatory proscriptions on particular pharmaceutical marketing activities.

- Regularly represents and defends aircraft and aircraft component manufacturers in cases involving fatal air crashes, as well as a variety of other commercial and business tort disputes relating to the marketing and sale of such products
- Recently obtained summary judgment on behalf of a major international airport in litigation involving personal injury claims
- Recently tried a case to a jury on behalf of a commercial waste disposal company involving claims regarding the proper treatment of industrial waste, as well as the recovery and retention of precious metals
- Served as lead trial counsel for a national bank in a lender liability action, defeating the plaintiff’s claims while obtaining a complete recovery on the client’s counter-claim
- Defended lending institution in connection with disputed sale and purchase of a professional sports franchise
- Arbitrated environmental preservation and restoration claims on behalf of prolific philanthropist and private equity principal
- Defended in litigation and at trial former members of board of directors in securities litigation involving the disputed tender offer and sale of a national restaurant chain
- Obtained orders of dismissal for several oil and gas services companies in municipal royalty / “takings” litigation filed in federal court
- Performed litigation due diligence in connection with a client’s acquisition of an international chain of hotels and casinos
