Sergey Kolmykov is a counsel in the New York office of Locke Lord LLP.
A registered attorney before the U.S. Patent & Trademark Office, Mr. Kolmykov is involved in all areas of intellectual property practice, concentrating on patent infringement litigation and risk arbitrage of intellectual property litigations. In addition to litigation, he has significant experience in patent prosecution, transactional work and client counseling.
With an electrical engineering background, he has represented clients in matters involving a wide variety of products and inventions, including electronics, wireless telecommunications, digital signal processing, digital and analog circuits, error control coding, video compression, computer software and business method arts, internet related applications such as Java, Javascript, HTML, ActiveX, Visual Basic, Perl, CGI, etc., satellite radio and video transmission, semiconductors including light emitting diodes, electro-mechanics, optics, nanotechnology and MEMS, e-commerce and financial systems.
Fluent in Russian and Ukrainian, Mr. Kolmykov has been involved in all aspects of patent litigation and client counseling, from initial infringement and validity opinions through appeal, including pretrial discovery and trial work, both on behalf of plaintiffs and defendants, potential and actual in the District Courts and the ITC.
In addition, Mr. Kolmykov has broad experience in licensing of intellectual property, due diligence investigations, and counseling on issues of infringement and validity. He was involved in analyzing multiparty licensing agreements, and evaluating patents for inclusion in certain multiparty licensing programs, including various licensing programs for MPEG-1 Audio, Layers I, II and III, MPEG-2, MPEG-4, CD, DVD, Blueray, AVCHD and other media related technologies.
Mr. Kolmykov is also experienced in trademark and copyright law matters, including WIPO domain name dispute resolution arbitrations and the Digital Millenium Copyright Act’s anti-circumvention clause and the Content Scrambling System utilized by MPAA DVDs.
