John E. Viskocil is an associate in the business litigation and bank regulatory & transaction departments at Locke Lord LLP. He focuses his practice on representing bank and financial institutions in class actions, multidistrict litigations and other complex litigation matters. John also represents loan servicers and trustees of asset-backed securities in mortgage defense actions, homeowner workouts, complicated foreclosures and disputes involving the origination and assignment of mortgages.
John represents consumer finance companies on federal and state regulatory compliance, including matters regarding the Truth in Lending Act, the Home Affordable Mortgage Program, Electronic Funds Transfer statutes, retail installment sales, rental purchase agreements, and individual state licensing, disclosure requirements, and usury limits. He develops financial products and contracts compliant with new state markets for his consumer finance clients.
Additionally, John advises finance companies, insurers, and energy companies on Dodd-Frank Act regulatory issues for swaps and security-based swaps transactions, including reporting, record keeping, clearing, and eligible contract participant requirements.
He counsels real estate principles and management companies on compliance with New York and New York City landlord and rent stabilizations statutes and regulations.
In the area of Chapter 11 bankruptcies, John has represented indenture trustees in adversary proceedings. He has also represented secured and unsecured creditors in defaulted commercial loan proceedings, medical device manufacturers in patent infringement cases, and automobile suppliers in commercial actions.
