The Impact of Federal and State Mortgage Lending Reform on Depository Institutions
In light of the recent subprime mortgage crisis, mortgage lending reform has become a top priority of both federal and state lawmakers. The reforms proposed and implemented by lawmakers will have a dramatic impact on depository institutions of all sizes. This presentation will survey the latest reforms and discuss the effect that such changes are likely to have on traditional mortgage lending by banks. In particular, the presentation will focus on the unintended consequences of mortgage lending reform and will cover a variety of issues such as state/federal conflict of laws, federal preemption, vicarious liability, and secondary market liability.
