Pat Coffey will be speaking at HFMA's Spring Institute & Vendor Show on April 18-20, 2011. Mr. Coffey will present during a session entitled "Healthcare Reform and Its Impact on Law Enforcement Activities and Related Legal Implications."
This session will discuss:
The aftermath of sweeping healthcare reform legislation, enforcement will further intensify with state and federal fraud authorities supported by whistleblowers, aiming to generate cases and significant recoveries under the False Claims Act, Stark, Anti-Kickback and other laws. This panel will explore the focus of healthcare enforcement in the current climate and discuss the ways that hospitals and other providers can take meaningful steps to reduce their exposure to liability and risk.
Drawing on actual experience in enforcement cases, the panel will identify common triggers for enforcement and aggravated sanctions, and offer their views on proactive steps that can help healthcare organizations reduce the potential for these challenging controversies. In this discussion, the Panel will discuss voluntary disclosures, “effective compliance” assessments, compliance monitoring protocols, certifications and other measures aimed at reducing the risk of fraud and abuse claims and penalties.
The speakers will also address:
- The new anti-fraud measures in the Accountable Care Act and related laws.
- Hospital-physician arrangements and other notable enforcement trends.
- Key healthcare compliance failures that continue to elevate enforcement risk.
- The use of good compliance to avoid CIAs, IROs, monitors and DPAs.
- Responding to government healthcare fraud investigations.
The panel discussion will also offer insights on how finance executives can assist in effectively conveying the educational and other information needed by management teams, compliance committees, and boards of directors to protect the organization against the escalating risk of fraud and related enforcement.
