Mr. Coffey will participate in a panel discussion titled, “The Reasons Your Compliance Program Does Not Reduce the Risk of Whistleblower Claims and FCA Enforcement.” Additional panelists include Linda Wawzenski, Assistant U.S. Attorney and Deputy Chief of Civil Division; Chris Mollet, Associate University Counsel, University of Illinois at Chicago and Marc Goldstone, Vice President and Associate General Counsel with Broward Health, Florida.

The panel will address False Claims Act actions and settlements involving whistleblowers, as well as enforcement, compliance and defense issues in whistleblower cases. The panel will discuss common triggers and compliance related deficiencies contributing to whistleblower claims, and offer their perspectives on better and proactive measures that can help reduce the potential for these difficult controversies. Additional topics to be covered include:

  • Current enforcement trends involving hospitals and systems
  • DRA and other drivers of FCA and whistleblower controversy
  • Key elements of an effective strategy to reduce the risk of whistleblowers
  • The role of governance in reducing the threat of FCA and whistleblower claims
  • Factors leading to aggravated settlements with CIAs, appointed monitors, and DPAs
  • Predictions for the future of government and relator action under state and federal False Claims Act.
